French troops enter Islamist stronghold in northern Mali

DOUENTZA, Mali - French troops took control on Wednesday of the airport of Mali's northeast town of Kidal, the last urban stronghold held by Islamist rebels, as they moved to wrap up the first phase of a military operation to wrest northern Mali from rebel hands.

A three-week ground and air offensive by French forces aimed at initially ending a 10-month Islamist rebel occupation of major towns is expected to eventually hand over to a larger African force.

The Africans' task will be rooting out insurgents hiding in the desert and mountains near Algeria's border.

"They (the French) arrived late last night and deployed in four planes and some helicopters," Haminy Belco Maiga, president of Kidal's regional assembly of Kidal, told Reuters.

However, the deployment of French troops to remote Kidal puts them in direct contact with pro-autonomy Tuareg MNLA rebels operating there.

The Tuaregs, whose separatist rebellion last year was hijacked by the Islamist radicals, say they are ready to fight al-Qaida, but many Malians blame them for triggering the collapse of democracy and division with their northern revolt.

France's military operation in its former West African colony involves around 3,500 troops on the ground backed by warplanes, helicopters and armored vehicles. It is aimed at heading off the risk of Mali being used as a springboard for jihadist attacks in the wider region or Europe.

French and Malian troops retook the major Saharan trading towns of Gao and Timbuktu at the weekend.

There were fears that many thousands of priceless ancient manuscripts held in Timbuktu, a UNESCO World Heritage site, might have been lost during the rebel occupation, but experts said the bulk of the texts were safe.

The United States and European governments strongly support the Mali intervention and are providing logistical and surveillance backing but do not intend to send combat troops.

The MNLA rebels, who want greater autonomy for the desert north, said they had moved fighters into Kidal after Islamists left the town earlier this week.

"For the moment, there is a coordination with the French troops," said Moussa Ag Assarid, the MNLA spokesman in Paris.

There were no reports of Malian government troops being in the town.

The MNLA took up arms against the Bamako government a year ago, seeking to carve out a new independent desert state.

After initially fighting alongside the Islamists, by June they had been forced out by their better armed and financed former allies, who include al-Qaida North Africa's wing, AQIM, a splinter wing called MUJWA and Ansar Dine, a Malian group.

French and Malian troops have retaken control of Timbuktu from Islamist rebels.  In the ancient city, much damage has been done, thousands of priceless manuscripts have been destroyed.  ITV's Tim Ewart reports.

Risk of attacks, kidnappings
But as the French wind up the successful first phase of their offensive, doubts remain about just how quickly the U.N.-backed African intervention force, known as AFISMA and now expected to exceed 8,000 troops, can be fully deployed in Mali to hunt down the retreating al-Qaida-allied insurgents.

French Foreign Minister Laurent Fabius said the French military operation, codenamed Serval (Wildcat), was planned to be a lightning mission that would last just a few weeks to avoid getting bogged down.

"Liberating Gao and Timbuktu very quickly was part of the plan. Now it's up to the African countries to take over," he told the Le Parisien daily. "We decided to put in the means and the necessary number of soldiers to strike hard. But the French contingent will not stay like this. We will leave very quickly."

Fabius warned that things could now get more difficult, as the offensive seeks to flush out insurgents with experience of fighting in the desert from their wilderness hideouts.

"We have to be careful. We are entering a complicated phase where the risks of attacks or kidnappings are extremely high. French interests are threatened throughout the entire Sahel."

An attack on the In Amenas gas plant in Algeria earlier this month by Islamist fighters opposing the French intervention in Mali led to the deaths of dozens of foreign hostages and raised fears of similar reprisal strikes across North and West Africa.

Need for reconciliation
While the French operation has made destroying Islamist fighters, positions and assets with air strikes a priority, analysts say a long term solution for Mali hinges on finding a political settlement between the northern communities and the southern capital Bamako.

"We reiterate that we are ready to talk with Bamako and to find a political solution. We want self-determination, but all that will be up to negotiations which will determine at what level both parties can go," Ag Assarid said.

However, there have been cases in Gao and Timbuktu and other recaptured towns of reprisal attacks and looting of shops and residences belonging to Malian Tuaregs and Arabs suspected of sympathizing with the MNLA and the Islamist rebels.

France has called for international observers to be deployed to ensure human rights abuses are not committed.

"Reconciling the Tuaregs with their Malian co-citizens will be extremely complicated," said Francois Heisbourg, a special adviser at the Foundation for Strategic Research, a Paris-based think-tank.

We have been trying to entertain Jake in quiet manners but it isn't really working. He is a hard man to keep down. As of now he has a black eye (from Jaileigh jumping on him), a scrape down his nose (from falling off the couch and hitting himself with his cast), and a hurt toe (don't know what happened), all to go with his broken arm. I keep telling him if he breaks his other arm he is going to have to stay on the couch allllllllll day long.

In?Slate?s?Justified?TV Club, Rachael Larimore will IM each week with a different fan of the FX drama set in Harlan County, Ky. She dissects Episode 4 with Jenn Lyon, who plays Lindsey Salazar. Disclosure: While Lyon plays Raylan?s girlfriend on television, in real life she's the girlfriend of Slate video producer Taige Jensen.

Rachael Larimore: Jenn, thank you for chatting with me. It?s fitting to be discussing Justified with someone who is affectionately known around the Slate offices as "Raylan's hot bartender girlfriend," because tonight's episode might as well have been called "Ladies' Night." Lindsey and Ellen May were both in the spotlight. I have a million questions for you about Lindsey.

Jenn Lyon: You?re welcome, and thank you for having me.

Larimore: In the big story line, Lindsey has disappeared with Randall (and Raylan's money), and we catch up with them at the slimy fight promoter's house. Lindsey had a moment where she seemed to be there reluctantly. Randall gave you a big hug and you turned away, a little distracted or conflicted. What was going on with Lindsey's emotions?

Lyon: The script said: ?Lindsey smiles, allowing herself to be manhandled by way of affection. But her eyes are on the money and nowhere else.? It was clear to me that they wanted the ambiguity and the distance between these conflicted actions she?s taking. You see her at the party and just think she?s bad, but then she makes that phone call from the gas station: Is she leaving clues for Raylan to follow or just flying by the seat of her pants? The writers don?t say one way or the other.

Larimore: I definitely felt that ambiguousness. Even up to the end, when Lindsey shot Raylan with the bean-bag gun but then turned and shot Randall, too. What does Lindsey get out of this adventure, besides Randall's car, which admittedly is a pretty great car? I feel like she got her freedom?Randall won't be able to bother again.

Lyon: I know! She?s pretty inscrutable and I like that. As the lady playing her, I had to make decisions as to why she is doing what she is doing, but I probably won?t tell those. It?s more fun to wonder: Did she love him or is she even capable of that? Is she just a predatory creature or is it a mix of appetites within one person? I will, personally, always go with the last one because its more interesting and gives you an obstacle to play. But yeah, she escapes with her freedom for now because the money has already been turned into fowl.

Larimore: Inscrutability is a great trait for Lindsey, but geez, but I?m talking to Jenn! Can you tell us a little bit about your take on Lindsey?

Lyon: ?OK, OK! Maybe I'm being too precious about all that. For me, Lindsey was falling for Raylan and was working hard to live on the straight and narrow. She imagined being a good woman, the right woman for Raylan, but then her old life came for her, and she had to do what she had to do to escape it.

Larimore: Lindsey?s escape kind of hits that note. We think she?s being sweet and good, when she tells Raylan his money was in the van, and then he makes his way over to the van and finds the chickens! That was a great comic moment, by the way.

Lyon: Dude, the whole episode is so funny. I laughed a lot watching it: the scene where Ellen May is trying to tell Ava that she would never let it slip that she killed Delroy and people keep walking past, or when Shelby hangs up on Boyd while he?s still talking, or Randall and Raylan?s repartee, or Rachel and the chicken breeder.

Larimore: Justified's comedy is underrated. And the best moments are when the characters aren't supposed to be funny. Like Ellen May with Ava, and all the people walking by. I'm sure that nailing the comedy aspect is as hard or harder than the drama. What are some of the other challenges you?ve encountered playing Lindsey?

Lyon: One challenge was wearing so little clothing: It was my first time ever making out on camera or just standing there half-naked and that?s real vulnerable and strange. Oh, and kissing Timothy and Robert was also a hardship that I had to endure for art.

Larimore: My (cough, cough) sympathies to you on all that making out with ruggedly handsome actors.

Lyon: if my boyfriend is reading this: "It was awful. They reeked of Chipotle." (It was great!! They smelled like dreamboats!!)

Larimore: A lot of actors and actresses mention that all that staged making out is awkward/boring/uncomfortable, but I?m sure that doesn?t stop the folks at home from thinking it must be simply dreamy. How do you prepare for those scenes?

Lyon: I prepare for those scenes by listening to hardcore rap and furiously brushing my teeth, both of which give me a false sense of confidence.

Larimore: I'll file that advice away! What would fans of Justified be surprised to hear about from behind the scenes? What is the creative process like on set?

Lyon: The speed and virtuosity of every department is crazy. From sound to lighting to art direction to props to hair and makeup/wardrobe, everyone is so on the ball and ready to collaborate, not just tell you what to do, which I?m told is pretty rare. The writers are constantly revising: The script you have worked on and memorized the night before could be totally different by the time you get to set, or they could change it while you?re rehearsing the scene. Tim might say that it feels clunky or the director doesn?t feel the right information is getting across, so the writers take that and go into a trailer and in five minutes you have a completely new monologue or they have pared down and reversed the order of things. On Tuesday you can get a version of a scene that has an armed robbery and a hostage crisis, and by Thursday, it?s been turned into a sweet conversation and a standoff. So, everybody has to be on their toes and the speed with which the regulars on the show can adjust and memorize new material is astounding. ?

Larimore: The show comes across as so carefully done, especially the dialogue. On the one hand you can imagine it going through a lot of rewriting; on the other, it's something else to think that it has to be relearned so quickly.

Lyon:??It?s such a specific kind of dialogue, too, and these writers are brilliant at it.

Larimore: Justified loves having parallels between its story lines, I've noticed. And in this episode we saw Lindsey disappear, and in the other storyline, Ellen May disappeared at the gas station after she wised up to the fact that Colt wasn't taking her to the bus stop. Ellen May has always represented to me a kind of "innocence lost." We see Boyd with his crime-lording and Ava with her brothel, and you don't necessarily think about how their actions trickle down to the people in Harlan. But then there's sad little Ellen May, who is an addict and a prostitute, but who somehow hangs on to this sweet na?vet?.

Lyon: I love it when you talk about the parallels and when people appreciate the show for how layered and multifaceted it is. I?m fucking nuts for Ellen May, and the actress that plays her is so wonderful both on the show and off. She plays her with such a lack of guile but at the same time, she is a survivor and has scrapped her way to staying alive many times.

Larimore: What do you think made Ellen May wise up to Boyd and Ava's plan to kill her? And do you think she'll be OK?

Lyon: Ellen May may not be the sharpest tool in the shed, but she is sensitive and observant, and when you have always been dependent on someone else for your survival, you watch them for signs of pleasure or disapproval or abandonment, not to mention she has been sober since the church stuff happened and that heightens her senses. I think she could tell by the way Ava was saying goodbye to her and the way Colt was treating her. It was all too good to be true.

Larimore:?I wasn't totally surprised to see her gone when Colt came out (He's turning into a real liability for Boyd, I think), but I was glad. I have a feeling will see her again. I wish I could say the same for Lindsey, but I suppose that is up to the writers, isn't it? They have left themselves some wiggle room.

Lyon: The writers say that if you don?t take a bullet you could always come back, so maybe Lindsey could figure in later, but Raylan needs to be a lone wolf, I think. I?m incredibly grateful to have gotten to work on it at all, so I don?t mind disappearing into the ether.

Larimore: That is something to look forward to. In the meantime, it?s time for us to escape. Thanks for chatting and for not taking $20,000 money from my sock drawer or shooting me with a bean-bag gun.

Jan. 13, 2013 ? Researchers at McGill University and the Research Center for Molecular Medicine (CeMM) of the Austrian Academy of Sciences have discovered the molecular blueprint behind the IFIT protein. This key protein enables the human immune system to detect viruses and prevent infection by acting as foot soldiers guarding the body against infection. They recognize foreign viral ribonucleic acid (RNA) produced by the virus and act as defender molecules by potentially latching onto the genome of the virus and preventing it from making copies of itself, blocking infection. The findings are a promising step towards developing new drugs for combatting a wide range of immune system disorders.

The discovery was made by teams led by Bhushan Nagar, a professor in the Department of Biochemistry at McGill's Faculty of Medicine, and Dr. Giulio Superti-Furga at the CeMM. Building on the 2011 CeMM discovery by Dr. Andreas Pichlmair that IFIT proteins unexpectedly interact directly with the viral RNA to inhibit its replication, the group's latest discovery reveals the molecular mechanism behind how IFIT proteins capture only the viral RNA and distinguishes it from normal molecules belonging to the host. Their research will be published on January 13 in the journal Nature.

"Infection by pathogens such as viruses and bacteria are caught by a layer of the immune system that consists of guard-like proteins constantly on the lookout for foreign molecules derived from the pathogen," explains Prof. Nagar. "Once the pathogen is detected, a rapid response by the host cell is elicited, which includes the production of an array of defender molecules that work together to block and remove the infection. The IFIT proteins are key members of these defender molecules."

When a virus enters a cell, it can generate foreign molecules such as RNA with three phosphate groups (triphosphate) exposed at one end, in order to replicate itself. Triphosphorylated RNA is what distinguishes viral RNA from the RNA found in the human host. During this time, the receptors of the innate immune system are usually able to detect the foreign molecules from the virus and turn on signaling cascades in the cell that leads to the switching on of an antiviral program, both within the infected and nearby uninfected cells. Hundreds of different proteins are produced as part of this anti-viral program, which work in concert to resist the viral infection.

In the Nagar lab, McGill graduate student Yazan Abbas used an arsenal of biophysical techniques, most notably X-ray crystallography, to capture the IFIT protein directly in the act of recognizing the foreign RNA. The work shed light on the interaction between IFITs and RNAs. The researchers determined that IFIT proteins have evolved a specific binding pocket, chemically compatible and big enough to fit only the triphoshorylated end of the viral RNA. Human RNA is not able to tightly interact with this pocket, thereby circumventing autoimmune reactions.

"Once the IFIT protein clamps down on the viral RNA, the RNA is then presumably prevented from being used by the virus for its own replication," says Superti-Furga, "Since many viruses, such as influenza and rabies, rely on triphosphate RNA for their lifecycle, these results have widespread implications in understanding how our cells interact with viruses and combat them."

This work could help advance the development of new drugs for combating a wide array of immune system disorders. "Our findings will be useful for the development of novel drugs directed at IFIT proteins, particularly in cases where it is necessary to dampen the immune response, such as inflammation or cancer therapy," says Nagar.

Forgiven credit card debt is often taxable: 1099-C forms follow debt settlement

If you thought your money woes ended last year when you settled that credit card debt, think again.

What you should know: Have you settled a debt with a creditor by paying less than you owe on a credit card debt? Congratulations on putting it behind you, but here's the bad news: The IRS considers forgiven or canceled debt as taxable income. You probably have to report it and pay taxes on it.
What to do: Experts advise consumers to seek tax advice before negotiating credit card debt settlements to avoid a surprise tax hit.

For many consumers with debt problems, after the debt collector leaves their lives, the taxman arrives.

Months after successfully resolving credit card debts, consumers may receive 1099-C "cancellation of debt" tax notices in the mail. Why? The U.S. Internal Revenue Service considers forgiven or canceled debt as income. Creditors and debt collectors who agree to accept at least $600 less than the original balance are required by law to file 1099-C forms with the IRS and to send debtors notices as well. Taxpayers must report that portion of forgiven debt as "income" on their federal income tax returns.

"A lot of people don't realize they have any tax issues at all when they are going through this," says Alison Flores, a researcher at The Tax Institute at H&R Block, the nation's largest tax preparation service. "They say 'I'm really poor, I'm broke and I can't pay my bills. How can you consider this income?'"

It is, according to the Internal Revenue Code. For example, a person with $10,000 in credit card debt who negotiates to pay only $6,000 of the balance would have $4,000 in forgiven debt income. That $4,000 must be reported as "other income" on Line 21 of the 1040 tax form. Depending on the amount of debt forgiven, the taxpayer's income level, deductions and other factors, the consumer could face a sizable tax bill come mid-April.

Surprise tax problem
The problem: Many consumers have no clue what the 1099-C forms are, and some may be trashing the cancellation of debt notices because the forms are sent by creditors or debt collectors with whom they thought they no longer had business. Still others are not filing the 1099-Cs with their federal income tax returns -- putting taxpayers at risk for IRS audits, penalties and fines. Consumer credit counselors and tax attorneys say few consumers are aware of the tax implications of settling to pay a lesser amount than they owe in credit card debt.

Just when they think the debt monkey is off their back, here comes the IRS obligation.

"It's truly something that consumers need to be aware of, as they are often blindsided by it," says Gail Cunningham, spokeswoman for the National Foundation for Credit Counseling, a nationwide group of nonprofit credit counseling agencies. "Just when they think the debt monkey is off their back, here comes the IRS obligation."

The number of "surprise" tax problems grew as the amount of bad debt rose during the recession, and has lingered since.

According to the IRS, the number of 1099-C cancellation of debt forms filed with the federal government by creditors and debt collectors more than tripled?between 2003 and 2010 -- the most recent year with firm figures. Most of the increase took place during the recession. The IRS received fewer than 1 million forms in the calendar year 2003 and more than 3.9 million in 2010. The projected number for?2012 was 6.4 million (see chart), and the IRS expects to get 6.5 million debt forgiveness forms in 2013.

A 2008 study by the National Taxpayer Advocate Service, a consumer branch of the IRS, found that credit card debt accounted for 47 percent of the 1099-Cs reviewed in a random sample of tax returns. Mortgage-related debt was only 15 percent of the sample. That was before the home foreclosure crisis and the proportion of mortgage-related debt forgiveness has likely increased, but a significant portion of it is still attributed to credit card debt.?

Canceled and forgiven debt may be taxable income for some consumers. According to the IRS, the number of taxpayers filing debt cancellation forms more than tripled?between 2003 and 2010. The IRS estimates the volume of filings?will continue to climb into 2015, when they will hit a projected 6.7 million.

Mark Steber, chief tax officer for the Jackson Hewitt tax preparation service, says his preparers have noticed an uptick in clients coming to them with 1099-C notices. "What we're seeing is credit card companies and credit agencies are being more liberal. We're seeing more forgiveness of debt," Steber says.

Negotiating with creditors, debt collectors and debt buyers to pay a fraction of the amount owed is a common practice in the industry, often accomplished through third-party agents such as consumer credit counselors or debt settlement specialists.

"Debt buyers are willing to negotiate a discount, sometimes at a very significant discount off the entire balance, to settle the debt," says Barbara Sinsley, general counsel for the 600-member Debt Buyers Association (DBA International), a trade group of companies that buy and sell portfolios of debt from banks and other creditors.

Not all forgiven debt taxable
Consumers who receive the 1099-C cancellation of debt forms should immediately take them to a tax preparer or tax adviser, experts say.

"Make sure your tax preparer understands the rules related to these type of activities," says Steber. "Ask to talk to an office manager. Tell them 'I need to see someone who understands this type of situation.'"

Taxpayers may qualify for one of several exclusions that allow them to reduce taxable income from canceled debts. If the exclusions apply, they must file an IRS form 982 in addition to the 1099-C.

"Theoretically, you have income [that can be taxed] if you don't meet one of the exceptions," says Eric L. Green, a tax attorney with the Convicer & Percy law firm in Glastonbury, Conn.

The exclusions include debts discharged during bankruptcy and debts of consumers who are insolvent (meaning their liabilities exceed their assets) prior to the cancellation of debt. However, the exclusion applies only up to the amount by which consumers are insolvent. That means if $5,000 in debts were forgiven and liabilities exceeded assets by $2,000, then the $2,000 would be excluded as income. "The remaining $3,000 would be reported under other income," says H&R Block's Flores.

DEBT RESOLUTION TAX TIPS
  • Consult a tax adviser before finalizing a debt settlement, and ask for a tax preparer who is knowledgeable about 1099-Cs.
  • Clarify with the creditor or debt collector the exact amount that will be declared on the 1099-C form.
  • Be aware that the 1099-C is coming. Don't throw it away. Take it to your tax preparer.
  • If there is a dispute about the amount reported on the form, contact the creditor or debt collector immediately to resolve the matter. Ask for a corrected 1099-C form.

Homeowners exclusion extended
Homeowners who default on mortgage loans on their primary residences may also qualify for an exclusion from income on foreclosures under the Mortgage Forgiveness Debt Relief Act, which took effect Dec. 20, 2007, to help homeowners caught in the mortgage crisis. This provision applies to up to $2 million in mortgage debt forgiven in calendar years 2007 through 2013. Taxes filed by the April 2014 deadline will be the last opportunity to claim the mortgage debt forgiveness exemption. This exception had been scheduled to expire at the end of 2012, but Congress extended it by a year as part of the "fiscal cliff" negotiations.

Steven M. Piascik, a certified public accountant and president of Piascik & Associates in Virginia, says, "If you use the proceeds from a home equity line of credit to pay off credit card debts, or for something other than making improvements to your home, that portion will not qualify for the $2 million exception."

If you used a credit card to pay for home improvements on your primary residence and can prove that the charges were exclusively for home improvements, you may be able to claim an exemption from mortgage-related debt forgiveness income for that card debt.

Informing consumers
Much of the surprise element of the 1099-C cancellation of debt forms could be eliminated, say tax preparers, if all creditors and debt buyers routinely informed consumers that there could be tax ramifications when settling debts for discounted amounts.

At Wells Fargo, one of the nation's five largest credit card issuers, all settlement-offer letters include disclosure of possible 1099-C implications, according to Lisa B. Westermann, assistant vice president of public relations for Wells Fargo Card Services. Other credit card issuers did not respond to requests for information about their policies.

Charge-offs contribute to taxable forgiven debt

Getting overwhelmed by debt from credit cards home loans became more common during the recession, and when that debt became impossible to pay, banks eventually charged off or wrote off the debts. That, in turn, helped cause a spike in 1099-C income tax notices. The chart shows the ratio of dollars written off compared to the amount of dollars loaned for credit cards and residential real estate loans.

"The bank doesn't tell you," says Green, the Connecticut tax attorney. "From the bank's perspective, it's not their job to give tax advice."

Says Sinsley from the debt buyers group: "There is no current law that says that a debt buyer must disclose that a 1099-C would be forthcoming after the settlement of debt."

She says debt buyers have been sued for the unlicensed practice of law after giving consumers advice on resolving their debts. It's something she advises her members to avoid. "A debt buyer is not the consumer's financial planner," she says. "Everybody's financial situation should be discussed with a tax adviser."

Knowing the amount of forgiven debt to be reported to the IRS would help consumers plan ahead, Sinsley says. "When they are negotiating the settlement of the debt, the consumer can discuss with their tax adviser what consequences there would be in exchange for the settlement of the debt," she says. "If the consumer is settling a debt, and they know the settlement is X and the forgiveness is Y, they can go to their tax preparer and say, 'If I do this, what is my tax impact?'"

The National Taxpayer Advocate Service has cited confusion and inadequate communication about 1099-Cs in its annual report to Congress on IRS improvements needed to help consumers. The IRS held a forum on understanding the tax consequences of canceled debt in 2009 to help clear up some of the confusion. The taxpayer advocate's office has also published YouTube videos in an effort to demystify the 982 tax forms needed to claim an exemption from taxes on forgiven debt.

Check the figures
Another tip from tax preparers: Make sure that the amount of canceled debt listed on the 1099-C form is accurate.

"If you get a 1099-C, make sure that you understand what that number represents," says Steber from Jackson Hewitt. Consumers may find the amount of forgiven debt on the tax notice much higher than they expected. "There's a sticker shock element," Steber says.

"They forgave $8,000 of my debt, but the 1099-C says $20,000. It's not simply the debt; it's the debt plus all the other things. They pay people to go and manage this [debt collection] to a degree and it costs money and sometimes a great deal of money to draw to conclusion and that's all included."

Steber adds, if there is a discrepancy, "you better go back and talk to them now and find out what it is."?

Another potential problem: receiving a 1099-C before the debt is actually paid off. According to Lauren Saunders, managing attorney for the National Consumer Law Center, creditors have sent cancellation of debt forms to consumers at the point that the credit card issuers charged off the debt and sold it to debt buyers. "The consumer is potentially liable both for taxes on supposedly forgiven debt while continuing to be liable for the debt," Saunders says. "We've had calls about that situation. Seems like you can't have it both ways: Either you forgive it or sell it but not both."

The federal taxpayer advocacy agency cited the gap in creditor reporting requirements as one of the most serious IRS consumer problems in its 2010 report to Congress. "A creditor that issues a Form 1099-C is not necessarily canceling a debt, yet the IRS assumes that Form 1099-C reflects taxable income to the debtor," according to the report. The taxpayer advocate recommended that the IRS revise the 1099-C form to include a box for creditors to indicate whether a debt was actually canceled. The IRS responded that it would consult its legal advisers.?

Several tax advisers called the 1099-C requirements unfair to consumers trying to overcome mountains of debt. Others say the tax rule is further proof that there is no free ride and consumers who borrow money must be prepared to live up to their financial obligations.

'Be aware of it and prepare for it'
The bottom line on 1099-Cs, says tax attorney Green: "Be aware and prepare for it. When you receive that form, go immediately to a tax adviser. Don't ignore it. That has real dollars and cents consequences."

Steber, from Jackson Hewitt, warns that the IRS is more advanced at tracking taxpayers' income. "There is an increased likelihood that if you had one of these events that the IRS knows about it," he says. "The IRS tracks it back. The IRS is quick to catch up with the person who, for whatever reason, left that [1099-C] off of their return."

Taxpayers who might have moved and didn't receive their 1099-C notices in the mail from creditors can't count on ignorance as a defense: "They will catch up with you," Steber says.

Xbox Music app for Windows 8 gets update

Microsoft continues to be pretty quick to release new updates for its in-house Windows 8 apps. Today, it's the Xbox Music app's turn for an upgrade, which can be downloaded right now via the Windows Store.

The release notes for the Windows 8 update state that this new build is supposed to have "improvements to simplify access to streaming music for free." The new version is also supposed to make it easier to move from a free trial subscription for the Xbox Music Pass service to the paid version. There's also been some fixes for "occasional playback concerns" and Microsoft has adding in additional bug fixes that have not yet been detailed.

All in all, this seems to be a relatively minor update to Xbox Music and while it may have some performance boosts, this new version may not be enough to satisfy the many users of the app who have complained about it in Neowin's forums since it launched. They have commented that Xbox Music does not have the same amount of functionality that Microsoft's Zune player once had.

Hopefully, we will see more features and improvements made for Xbox Music in the weeks and months ahead.

It's not only 'artsy' people who benefit by having a creative talent. Creativity is the basis of solutions to even the most mundane problems people face in life. It's a spark of creativity that brings an idea for many new business startups. Creativity also plays an important part in solving problems both in everyday life as well as in the workplace.

One of the things that creative people have in common is passion. While discipline is important and a person can be trained in discipline, when passion is already present, you don't have to train yourself to become disciplined. The passion for what you are doing will drive the discipline naturally.

Being interested in something isn't the same thing as passion. While interest will drive creativity at first, when the interest diminishes, creativity for the subject may diminish as well. Don't make the mistake of waiting for inspiration and passion. Get in the habit of being creative by searching out a task or problem that needs a creative solution every day. Get to know yourself and what your enjoy doing, not just what you know that you are good at.

Many people who have doubted that they had the ability to write were surprised to find that journaling was a key to finding inspiration and passion. When convinced that their writings didn't have to be shared with or judged by others, the journaling process was allowed to succeed and being free to write about anything without the fear of being judged allowed new ideas to present themselves almost magically on the paper.

Doodling also can bring hidden ideas to light. When the hand is allowed to work on its own, it's surprising what it can tell you about yourself. When you are faced with a problem that needs a creative solution, don't just look at it like it was a roadblock that won't let you through. Change your way of thinking about it. Look at it from a different angle. Step back from the problem and let it compost for a while. Draw the problem out and doodle your way to a solution.

Be confident that you are creative and creativity will come.

Why good resolutions about taking up a physical activity can be hard to keep

Jan. 4, 2013 ? Physical inactivity is a major public health problem that has both social and neurobiological causes. According to the results of an Ipsos survey published on December 31, the French have put "taking up a sport" at the top of their list of good resolutions for 2013. However, Francis Chaouloff, research director at Inserm's NeuroCentre Magendie (Inserm Joint Research Unit 862, Universit? Bordeaux S?galen), Sarah Dubreucq, a PhD student and Fran?ois Georges, a CNRS research leader at the Interdisciplinary Institute for Neuroscience (CNRS/Universit? Bordeaux S?galen) have just discovered the key role played by a protein, the CB1 cannabinoid receptor, during physical exercise. In their mouse studies, the researchers demonstrated that the location of this receptor in a part of the brain associated with motivation and reward systems controls the time for which an individual will carry out voluntary physical exercise. These results were published in the journal Biological Psychiatry.

The collective appraisal conducted by Inserm in 2008 highlighted the many preventive health benefits of regular physical activity. Such activity is limited, however, by our lifestyle in today's industrial society. While varying degrees of physical inactivity may be partly explained by social causes, they are also rooted in biology.

"The inability to experience pleasure during physical activity, which is often quoted as one explanation why people partially or completely drop out of physical exercise programmes, is a clear sign that the biology of the nervous system is involved," explains Francis Chaouloff.

But how exactly? The neurobiological mechanisms underlying physical inactivity had yet to be identified.

Francis Chaouloff (Giovanni Marsicano's team at the NeuroCentre Magendie; Inserm joint research unit, Universit? Bordeaux S?galen) and his team have now begun to decipher these mechanisms. Their work clearly identifies the endogenous cannabinoid (or endocannabinoid) system as playing a decisive role, in particular one of its brain receptors. This is by no means the first time that data has pointed to interactions between the endocannabinoid system, which is the target of delta9-tetrahydrocannabinol (the active ingredient of cannabis), and physical exercise. It was discovered ten years ago that physical exercise activated the endocannabinoid system in trained sportsmen, but its exact role remained a mystery for many years. Three years ago, the same research team in Bordeaux observed that when given the opportunity to use a running wheel, mutant mice lacking the CB1 cannabinoid receptor, which is the principal receptor of the endocannabinoid system in the brain, ran for a shorter time and over shorter distances than healthy mice. The research published in Biological Psychiatry this month seeks to understand how, where and why the lack of CB1 receptor reduces voluntary exercise performance (by 20 to 30%) in mice allowed access to a running wheel three hours per day.

The researchers used various lines of mutant mice for the CB1 receptor, together with pharmacological tools. They began by demonstrating that the CB1 receptor controlling running performance is located at the GABAergic nerve endings. They went on to show that the receptor is located in the ventral tegmental area of the brain (see diagram below), which is an area involved in motivational processes relating to reward, whether the reward is natural (food, sex) or associated with the consumption of psychoactive substances.

Based on the results of this study and earlier work, the Bordeaux team suggests the following neurobiological explanation: at the beginning and for the duration of physical exercise, the CB1 receptor is constantly simulated by the endocannabinoids, lipid molecules that naturally activate this receptor in response to pleasant stimuli (rewards) and unpleasant stimuli (stress). Endocannabinoid stimulation of the CB1 receptor during physical exercise inhibits the release of GABA, an inhibitory neurotransmitter that controls the activity of the dopamine neurons associated with the motivation and reward processes. This stimulation of the CB1 receptor "inhibits inhibition," in other words, it activates the dopaminergic neurons in the ventral tegmental area. The CB1 receptor must therefore be stimulated before the exercise can go on for longer and the body must receive the necessary motivation.

Conversely, without these CB1 receptors, the "GABAergic brake" continues to act on the dopaminergic neurons in the ventral tegmental area, leading to the reduced performance levels observed above.

It is already known that CB1 receptors play a regulatory role in the motivation to consume rewards, whether natural or not. What is original about this research is that it shows that physical exercise can be added to the array of natural rewards regulated by the endocannabinoid system. "If confirmed, this motivational hypothesis would imply that the role played by the CB1 receptor has more to do with 'staying power' in the exercise than with actual physical performance levels" explain the researchers.

This work reveals that the endocannabinoid system plays a major role in physical exercise performance through its impact on motivational processes. It thus opens up new avenues of research into the mediators of pleasure -- and even addiction -- associated with regular physical exercise. "After endorphins, we now need to consider endocannabinoids as another potential mediator of the positive effects that physical exercise has on our mood," the researchers conclude.

(AP) ? Terell Floyd and the Louisville Cardinals gave the embattled Big East Conference at least one more triumphant night in a major bowl ? and at the expense of a top team from the mighty SEC.

Floyd returned an interception 38 yards for a touchdown on the first play, dual-threat quarterback Teddy Bridgewater directed a handful of scoring drives and No. 22 Louisville stunned the fourth-ranked Gators 33-23 in the Sugar Bowl on Wednesday night.

"I can't speak for the whole Big East, but I can speak for Louisville and I think this means a lot for us," Floyd said. "We showed the world we can play with the best."

The Big East is in a transitional phase and losing some of its top football programs in the process. Boise State has recently backed out of its Big East commitment and Louisville has plans to join the ACC.

Even this year, the Big East wasn't getting much respect. Louisville, the league champion, was a two-touchdown underdog in the Sugar Bowl.

But by the end, the chant, "Charlie, Charlie!" echoed from sections of the Superdome occupied by red-clad Cardinals fans. It was their way of serenading third-year Louisville coach Charlie Strong, the former defensive coordinator for the Gators, who has elevated Cardinals football to new heights and recently turned down a chance to leave for the top job at Tennessee.

"I look at this performance tonight, and I sometimes wonder, 'Why didn't we do this the whole season,'" Strong said. "We said this at the beginning: We just take care of our job and do what we're supposed to do, don't worry about who we're playing."

Shaking off an early hit that flattened him and knocked off his helmet, Bridgewater was 20 of 32 passing for 266 yards and two touchdowns. Among his throws was a pinpoint, 15-yard timing toss that DeVante Parker grabbed as he touched one foot down in the corner of the end zone.

"I looked at what did and didn't work for quarterbacks during the regular season," said Bridgewater, picked as the game's top player. "They faced guys forcing throws ... and coach tells me, 'No capes on your back or 'S' on your chest, take what the defense give you.' That's what I took. Film study was vital."

His other scoring strike went to Damian Copeland from 19 yards one play after a surprise onside kick by the Gators backfired. Jeremy Wright had a short touchdown run that gave Louisville (11-2) a 14-0 lead the Gators couldn't overcome.

Florida (11-2) never trailed by more than 10 points this season. The defeat dropped SEC teams to 3-3 this bowl season, with Alabama, Texas A&M and Mississippi still to play.

"We got outcoached and outplayed," Florida coach Will Muschamp said. "That's what I told the football team. That's the bottom line."

Gators quarterback Jeff Driskel, who had thrown only three interceptions all season, turned the ball over three times on two interceptions ? both tipped passes ? and a fumble. He finished 16 of 29 for 175 yards.

Down 33-10 midway through the fourth period, Florida tried to rally. Andre Debose scored on a 100-yard kickoff return and Driskel threw a TD pass to tight end Kent Taylor with 2:13 left. But when Louisville defenders piled on Driskel to thwart the 2-point try, the game was essentially over.

Florida didn't score until Caleb Sturgis's 33-yard field goal early in the second quarter.

The Gators finally got in the end zone with a trick play in the closing seconds of the half. They changed personnel as if to kick a field goal on fourth-and-goal from the 1, but lined up in a bizarre combination of swinging-gate and shotgun formations and handed off to Matt Jones.

The Gators tried to keep the momentum with a surprise onside kick to open the third quarter, but not only did Louisville recover, Florida's Chris Johnson was called for a personal foul and ejected for jabbing at Louisville's Zed Evans. That gave Louisville the ball on the Florida 19, from where Bridgewater needed one play to find Copeland for his score.

"We game-planned it and felt good about it," Muschamp said of the onside kick attempt. "We wanted to steal a possession at the start of the second half."

On the following kickoff, Evans cut down kick returner Loucheiz Purifoy with a vicious low, high-speed hit that shook Purifoy up. Soon after, Driskel was sacked hard from behind and stripped by safety Calvin Pryor, ending another Florida drive with a turnover.

"We had the right attitude, had the right mindset that we would go out and beat this team," Pryor said.

After Louisville native Muhammad Ali was on the field for the coin toss, the Cardinals quickly stung the Gators. Floyd, one of nearly three dozen Louisville players from Florida, made the play.

Driskel was looking for seldom-targeted Debose, who'd had only two catches all season.

"I threw it behind him, (he) tried to make a play on it, tipped it right to the guy," Driskel said. "Unfortunate to start the game like that."

When Louisville's offense got the ball later in the quarter, the Florida defense, ranked among the best in the nation this season, sought to intimidate the Cardinals with one heavy hit after another.

One blow by Jon Bostic knocked Bridgewater's helmet off moments after he'd floated an incomplete pass down the right sideline. Bostic was called for a personal foul, however, which seemed to get the Cardinals opening drive rolling. Later, Wright lost his helmet during a 3-yard gain and took another heavy hit before he went down.

Louisville kept coming.

B.J. Butler turned a short catch into a 23-yard gain down to the Florida 1. Then Wright punched it in to give the Cardinals an early two-TD lead over a team that finished third in the BCS standings, one spot too low to play for a national title in Miami.

Former Commerce and Industry Minister Sam Mpasu says the only way Malawi can rid itself of the forex troubles that have crippled the country is to promote a vibrant manufacturing industry.

Malawi is bleeding profusely from a lack of forex which has resulted in acute shortages of fuel, which in turn has had a ripple effect, the most evident being the escalating cost of living.

Mpasu, who is an economist by training, said in an exclusive interview with Nyasa Times that ?the underlying problem of forex is structural in the sense that there has not been a deliberate political will to review government policies for the benefit of local manufacturers and export development.

?So, one, the end result is that Malawi is relying too much on donor support although the donors have plainly told us to rely on trade and not aid.

Mpasu:

?And two, because of lack of local manufacturing, there is no input substitution. We are exporting things that we can easily manufacture, for instance kaunjika (second-hand clothers).This country can make its own dresses and clothes because we grow cotton in abundance,? he said.

The former Speaker of Parliament, who served various ministrial portfolios in the UDF government, said the third dimension is that Malawi talks about exports but does not talk about producing for exports.

?There is no deliberate effort to produce certain products for particular markets. The exports that this country is relying on are all commodities. We export tobacco in its raw form so that others may refine it for us and import is back to us. All the sugar that we export is for the trade protocol. And the tea is sold at Lime Auction Floors.

?We have to move away from export commodities. Of course, we have now expanded to mining and rare earth but these are still commodities. We need to promote local manufacturing and, in the process, you create thousands and thousands of jobs. And when you do that, you expand the base for government revenues,? he notes.

Mpasu says there is no solution in sight as long as the country continues to import toothpicks while it produces and exports tonnes of timber.

He observes that the long-term solution is to review policies and make it possible to manufacture products here than to import.

?It?s uneconomical to manufacture anything in Malawi because it is undermined by cheaper imports. If government can?t solve that problem, then this country will always rely on donors.?

Mpasu called on the political leadership to make an effort to understand the problem at hand.

?We have to have presidents who understand the importance of the economy. If they don?t, they should get ministers who understand. We have to have a government that knows what is wrong and implements policies that right the wrongs.?

Trade not aid

On the decision by the government to devalue the Kwacha and float it against the US dollar, Mpasu said the Joyce Banda administration had no choice.

?As long as we rely on donor hand-outs, then we have very little options,? he said. ?The heart of the matter is that you don?t have enough exchange.?

Since the currency was devalued by a third in May, it?s slumped 26 percent against the dollar, making it the worst- performing unit in Africa. That?s boosted inflation in the southern African nation to 33 percent in November from 30.6 percent in the previous month and prompted the central bank to raise its benchmark interest rate by 4 percentage points to 25 percent on Dec. 4.

However, Mpasu noted that there were two mistakes that the government committed in relation to the devaluation.

?They announced the devaluation before they had made corrective measures. And secondly, they should have floated the currency within a certain band and not let it float freely.?

Mpasu also challenged government to figure out ways in which the country can wean itself from donor dependency.

?Aid is charity. The donors are tired of supporting us. They have been doing it for 50 years and we ought to do something on our own. When will we grow up?? he questioned.

Consumer groups are planning nationwide protests on Jan. 17 against soaring costs and to force the government to reverse the currency devaluation.
